Plaintiff was a scientist in her late 30s working for a medical research company. Shortly after she began her employment one of the executives of the company pursued a romantic relationship with plaintiff. Plaintiff consensually entered into that relationship. However, once the executive began to be abusive within the relationship she extricated herself from the relationship and made it clear that she was not interested in any further contact.
The executive continued to aggressively pursue plaintiff, and when she would not comply with his sexual demands she alleged that he demoted her and took her off important projects.
While plaintiff was represented by a prior attorney, the company took the position that whatever sexual contact plaintiff had with the executive was always consensual and it was plaintiff who continued to pursue the executive after he attempted to extricate himself from the relationship. Further, they claimed that plaintiff was never demoted and any change in assignments was plaintiff’s choice. Plaintiff’s prior attorney was not a trial lawyer, and without the threat of litigation and trial the company failed to act reasonably to resolve the case.
