Plaintiff was a 25-year-old male who worked in the warehouse of a national corporation with many stores across the country and California. Plaintiff alleged that he was sexually harassed by several male co-workers who would jump him, wrestled him to the ground and humped him, claiming that they “owned” him, which resembled a prison ritual and that he was harassed by a female co-worker who made disgusting sexual comments to him and pinched his buttocks with wire-cutters. Plaintiff alleged that he and others complained to store management about the ongoing problems with harassment, yet, no action was taken.

The store finally performed an investigation after plaintiff made his claim and found that the sexual harassment had indeed occurred and fired many of the perpetrators. However, the store claimed to not have notice of the harassment until the lawsuit was filed.

The Law Offices of Winer, McKenna, Burritt & Tillis LLP, who filed a lawsuit, alleged that the store, did in fact have knowledge of the ongoing harassment because multiple complaints have been made to the store manager. The fact that the store manager may have failed to report the harassment to Human Resources, was not plaintiff’s problem, but rather the company’s.

The case settled before plaintiff’s deposition was completed.

RESULT: $400,000 settlement for plaintiff.
