Twenty Five Year Old Woman Sues a Temp Agency and The Company That Employed Her For Sexual Harassment

Plaintiff was a twenty five year old woman who had been out of the work force for several years having children and then registered with a temporary placement agency. The agency placed her at a corporation and once placed at the corporation she alleged that she was verbally sexually harassed by a manager of the company. She alleged that she reported that sexual harassment to the temporary agency and they did not do anything to stop it. Once the case was filed the temp agency took the position that plaintiff did not report the sexual harassment to them until her last day at work, which, if proven would have cleared them from any responsibility for the sexual harassment of the perpetrator. The perpetrator and the corporation that employed him took the position that her sexual harassment never happened and along with the temp agency attacked plaintiff’s credibility. Winer, McKenna, & Burritt through litigation were able to put the defense position in doubt and resolve the claim despite significant credibility issues with the plaintiff’s testimony.

RESULT: Settlement on behalf of plaintiff $175,000.
