Plaintiffs alleged that the warden at a prison where they worked verbally sexually harassed them on a frequent basis. When plaintiffs and another woman finally complained the investigation took almost a year to complete, despite the fact that California law mandates a prompt and reasonable investigation.

The State claimed that the sexual harassment was not severe and pervasive under legal standards and any delay in the investigation was caused by plaintiffs’ refusal to cooperate, as opposed to any desire on behalf of the State to delay the investigation.

The case reached a tentative settlement after an intensive litigation.
